Female College Student Headed to Jail After Falsely Accusing 2 Athletes of Rape

Nikki Yovino, a Long Island woman who admitted making up a rape accusation against two Sacred Heart University football players, will be spending a year in jail as part of a plea agreement that spared her the six-year sentence she had faced.
The former Sacred Heart University student agreed to the plea deal Tuesday, the Connecticut Post reported.
Instead of the felony charges she faced, and the six-year sentence that went along with them, Yovino pleaded guilty to two counts of second-degree falsely reporting an incident and one count of interfering with police. All of the charges are misdemeanors.
According to the deal, Yovino will be sentenced on Aug. 23 to three years in prison, which will be suspended after the first year, followed by three additional years of probation.
“We were prepared to go to trial on the original felony charge, but after lengthy discussions with all parties involved and considering all outside factors, this was an appropriate disposition that will hopefully set a precedent about how serious the state takes this conduct,” Senior Assistant State’s Attorney Tatiana Messina said in court.


“The important thing is that the victims are happy with the disposition,” Assistant State’s Attorney Emily Trudeau said.
Yovino, of South Setauket, New York, had originally claimed she was raped during an off-campus party in October 2016. Sacred Heart University is located in Fairfield, Connecticut. The alleged incident took place in Bridgeport.
According to the affidavit for Yovino’s arrest, she changed her story three months later when questioned by Detective Walberto Cotto Jr.
“She admitted that she made up the allegation of sexual assault against (the football players) because it was the first thing that came to mind and she didn’t want to lose (another male student) as a friend and potential boyfriend,” according to the affidavit. “She stated that she believed when (the other male student) heard the allegation it would make him angry and sympathetic to her.”

The two men falsely accused may sue Yovino, said Frank Riccio II, who represents them.
“While this disposition does not replace that which the boys lost, it does send a powerful message that lying about a serious incident carries serious consequences,” Riccio said.
The names of those accused of rape were never released.
Nikki Yovino’s actions “seriously affected” the two men, Riccio said.
“They’re no longer in school,” Riccio said. “The loss of their education and the college experience has certainly affected them greatly. And this is all because of a very serious lie.”



Comments in the affidavit and from the college about the fate of the men are contradictory, the Connecticut Post noted in a 2017 article.
In the affidavit, Cotto said one of the players “lost a year of NCAA sports eligibility and his Division 1 NCAA football scholarship.” The Post reported, citing a source it did not name, that the other player also lost his scholarship.
Sacred Heart University Communications Director Deb Noack said that was not so.
“Sacred Heart never expelled the two students nor was any student stripped of scholarships because of any allegations,” she said.

One in a while our court system works but she had to confess to get caught, pity.

I won't deny that it happens, but for every one "false rape accusation" news I can post 100 news about ACTUAL rape that happened where the rapist was not punished.
 
While I think the sentence should be longer, this is a good step in the right direction.

False rape reports do so much damage to real victims. So much damage to the people the falsely accuse. So much damage to the family and friends of those they accuse. It is disgusting.

I think she should have got more time. An example needs to be set if we are going to help real victims and protect others from false accusations that are this damaging.
 
She is pretty but evil.

it is disgusting. completely downplays the real victims when more stories of fake victims getting caught pops up :(
 
I'll admit I totally agree with Jessica and Muckchelle.

I dunno... maybe it's MRA-esque-ness of these kind of threads that initially rubbed me the wrong way. I'll admit that if I was the person I was 6 years ago I would have flooded entire forums with stories of men being falsely accused of rape. Then I learned that for every person being falsely accused of rape there's 100 others who have been victims of rape where the rapist don't get punished (especially when the man is rich and is a well known celebrity and/or a high school popular jockstar or something).

Not to say that it's false rape accusations doesn't happen, in fact I believe that men who are marginalized (lower class men, homeless men, men of colour, men with disability, autistic men) are more likely to be falsely accused of rape so any story of false rape accusations should mainly cater to those audiences. I mean compare a woman saying "a rich comedian raped me" vs "a homeless man raped me", if she said the latter most people would want the homeless man's head on a stick. People are not intersectional that's the problem.

A good example would be when Trump falsely accused Mexican men of being rapists.

I know of a story of a 16-year old gay boy who was harassed by a girl (because she was stalking him and he didn't want to date her) so she tried to control him by faking a rape charge on him. Unfortunately he was initially punished, and it took a LONG-ASS fucking while just to prove that she was lying. In that situation the male was in a vulnerable state making it easy for him to be falsely accused of shit he did not commit. So in that situation I fully agree with everyone on this forum - a shitty crime like that deserve something serious, like an expulsion and then she should be sent to prison.

This also ties in to the "if you fuck your way to the top isn't it called prostitution" thread and honestly the amount of rich privilege and class privilege that is displayed is something I really need to address. Notice every discourse of "false rape accusations" is based on the premise that the man is rich and that the woman faked an accusation just to get some of his money or wealth? Never mind the fact that most rape accusations are real, but what about other instances of woman faking a rape or sexual assault charge on a man and the man was NOT wealthy or rich? Let's say the woman is an ablist piece of shit who hates autistic men and think all autistic men are "potentially rapists" - now I think that's a much more concerning thing to talk about.
