That's our legal system, not to be confused with a justice system.
I particularly get a kick out of another judges comment on the case,...

Nah - it was a sentencing hearing in which guilt was already determined and sentencing carries guidelines, max sentences, min sentences, etc. So following those, even after crying at a victim statement, is not hard.
Controlling one's emotions during a victim impact statement are certainly different than overall control of one's feelings. A victim impact statement is meant to do exactly that. Make everyone who hears feel part of what the victim felt when they were affected by whatever crime that happened. Judges are quite often moved by these statements. They are allowed because it is the only time that a victim can really express the true impact the crime had on them. Just because she cried doesn't negate the fact that another judge could have been equally moved by the statement but just didn't shed a tear.

The judge would but there is always sentencing guidelines to follow that have already been put on the books. It is not like she can sentence the man to death when we have no death penalty. Just like she could not sentence for life if the max sentence is 5 years.

I am glad he was arrested and convicted and I hope he gets the book thrown at him. What I don't understand is why the wife has not been charged either. Obstruct justice, perjury, and I am sure there is some type of charge relating to letting your hubby sexual assault a woman beside you and not doing anything to stop it.
