Sorry to disagree, but rape is, last time I checked, defined as forced sexual intercourse (insertion), whereas slapping someone with your penis is sexual assault. Neither are acceptable, of course, but he won't get convicted of rape if there was no penetration.

They actually did change it for precisely this reason. The criminal code replaced 'rape' with 'sexual assault' to be able to deal as severely with cases where there was no penetration as they were able to where there was.
