Judge overturns California's gay marriage ban

A federal judge today California’s ban on gay marriage, saying the voter-approved initiative violates both the due-process and equal-protection clauses of the U.S. Constitution’s 14th Amendment.

U.S. District Judge Vaughn Walker's does not make gay marriage legal in California immediately. The effect of the decision is on hold while Walker decides whether it should be suspended as defendants appeal the case to the 9th U.S. Circuit Court of Appeals.

So now what, GAYS have no rights?. :neutral:

Thx for the heads up BT . Me and a lady friend are having dinner with friends who happen to be a gay couple so I will be able to impress them with my knowledge of current events . They know I rarely watch main stream news so now I need a cover on where I found out about this step forward for human decency in Arnold's House .

If he's smart he can appeal to the gay vote with something clever like

" I got your baaack " .

BTW - I do know Arnie is on record as opposing legalizing gay marriage unless it's between a man and a woman .

Gov. Arnold Schwarzenegger praised a San Francisco's judge decision throwing out California's ban on same-sex marriage, saying it "affirms the full legal protections and safeguards I believe everyone deserves."

"He heard in-depth arguments from both sides on fundamental questions of due process, equal protection and freedom from discrimination. There are strong feelings on both sides of this issue, and I am glad that all viewpoints were respected throughout the proceedings," he said. "We should also recognize that there will continue to be different points of view in the wake of this decision."

The governor added that the decision "provides an opportunity for all Californians to consider our history of leading the way to the future, and our growing reputation of treating all people and their relationships with equal respect and dignity."

Los Angeles Mayor Antonio Villaraigosa also praised the ruling: "Because a judge had the courage to stand up for the constitution of the United States, prop 8 has been overturned!" he wrote on Twitter.
