The state Supreme Court in North Carolina ruled that women cannot take back consent once she agrees to having sex.Sorry, what?

Yeah, you did read that, once a woman agrees to having sex, her partner can legally ignore her if she says she’d like to stop.

According to the 1979 case State v. Way: “If the actual penetration is accomplished with the woman’s consent, the accused is not guilty of rape.”

Lynn Schafran, senior vice president of Legal Momentum, said she had never seen anything like this ruling before.

This one is a tough one to debate about. As a man's point of view, once you say yes in the heat of the moment. How the Hercules do you want us to stop once we are about to enter you?. Really, think about it.

Now in the story,

In one case, Amy Guy told local news station WRAL that her estranged husband showed up at her house, demanding sex. At first she consented, but begged him to stop when he became violent.Ms Guy’s husband, Jonathan Wayne Guy, was initially charged with second-degree rape but because of State v Way, his charges were dropped to ‘misdemeanour assault on a female’.
Guy plead guilty to that charge and is currently serving a 10 month prison sentence.


I think she had a right to say stop, no, get the fuck out of me.

I know it is hard for some men to wrap their head around scenarios like that because you are not looking to slap a lady while fucking her, or at least most here, I would think, would ask before the slap. However, as with all things in life, not everyone is like you. So not all men are alike. There are quite a few men who act wrong after consent as been given. The right to say no at anytime by either party should not be a debate and certainly should not be taken away.

I bring up the slap because I have had that happen. We were fucking for 10-15 minutes and the all of a sudden, he slapped me. This was a BF at the time, ex now of course. I was shocked at first, he slapped me a few more times. Like in the face. Open hand slap right across the face. Turned into a bit of struggle as I tried to defend myself after the shock and about 2 more slaps. He came, I guess it was exciting for him, so all was said and done. He got up and showered, I cried. Of course this was an abusive relationship that I was victim to for years even after this, but it was not the first or last time he had sex with me that I didn't want and he knew it because I told him.

So I can see reason for a anyone to be able to say no during the actual act of sex. No means NO. There are no ifs, ands or buts about it.

Thank you for sharing that. What an awful scenario to be in. I'm glad the ex is history and you are stronger than you were.

If she says, "Stop!" or "No". Just stop.

I hadn't considered this scenario at all. Really puts that possibility into perspective.

And of course I'm sorry you were subjected to that abuse.
 
Yikes. I live in North Carolina, and this is going to flash through my head every time I'm deciding if a guy is getting in or not.
 
That is disturbing I hope she has success with changing the law. And I'll add my thanks to @jessica for sharing her story, sorry you had to experience that.

Stealthing is another scenario where I can see a woman withdrawing consent after the fact. Again another wonderful thing the ex did. The first night we ended up having sex which was 6 weeks into dating, I might add, this is what he did. 3-4 condoms all either "broke" or "fell off" and couldn't be found????? It was a bit of a marathon of sex which was great but I could not figure out for the life of me why the condoms kept having issues. I found out of course a couple years later into our relationship that he kept breaking or removing. I admit I was stupid and did even know that was a possibility but a smarter girl may have and demanded the sex stop then. He thought I should have felt special that he "knew right away that I was the one" So he did't see the need to be safe. Besides, he knew I was clean so it was okay. That is what he said when explaining it a few years later. When the topic came up in the new recently and I reminded him of the first time we had sex, he said " that is not the same thing." I know I was so stupid.

As gentlemen, most of you will never think of scenario's like these because this type of assault is not something on your minds. It just doesn't enter so it doesn't compute, but for us woman, sadly we do think about it because if we don't personally experience it in our life, we generally personally know someone who has. It is a very sad but real truth.


In my case, this was clearly a very abusive relationship from the beginning. Ful on emotionally, mentally and physically but also sexually abusive. Many would consider what he did as sexual assault or rape. I have no idea how to look at it other then abuse. I am thankful to be out, but the damage was done and I am still working through it and healing my wounds into scars. Not much more I can do about that.

Madman - you will be happy to know that towards the very end of our relationship, I did punch him in the face and ring his bell good. I don't like that I got to that point, but I do feel like I finally stepped up for myself. I can say, he never put his hands on me again after that. He was out the door officially just a couple of months later, but I figure that is only because he lost his power and control once I started to fight back.
