The majority of people can't hit the broadside of a barn from where the perp was when the Officer pulled up. It's when he got closer to the car that I would've stopped the warnings and shot.
He did a better job at being patient than I would have but adrenaline says a lot and the Officer could've been panicking and not knowing what the right choice would be in that situation.
