Former New York Police Captain Mistakenly Shoots, Kills Son

New York cops are trying to determine whether to file charges against a retired police captain who mistook his son for an intruder and shot him at an Adirondacks motel.

"We're concerned with whether or not the shooter was intoxicated, and whether or not the victim was intoxicated, or both," said Jeff Carpenter, acting district attorney for Herkimer County, N.Y., who is assisting with the investigation.

Michael Leach, 59, and his son, Matthew Leach, 37, of Rochester, N.Y., were staying at Clark's Beach Motel in Old Forge, N.Y., over the weekend during an outing with the Rochester chapter of the .

Michael Leach is a retired captain of the Rochester, N.Y., police department.

According to Dan Rivet Jr., the motel's owner and lead paramedic on the case, members of the club had been drinking a few beers Friday evening outside their rooms. While others lingered early into Saturday morning, Michael Leach had gone to bed, he said.

But around 12:51 a.m. Saturday morning, Michael Leach called 911 to report that he had shot his son, Matthew Leach, with his service weapon, a .45-caliber Glock handgun, thinking he was an intruder, according to state police.​

Here is one where a 3 year old shoots dad.

California’s Second District Court of Appeal said on Tuesday that a paralyzed Los Angeles police officer, who was shot by his 3-year-old son, could move forward with his lawsuit again gun manufacturer Glock.

Enrique Chavez’s lawsuit claimed that the Glock 21 had a light trigger and lacked a grip saftey, both of which could have prevented the shooting.
Los Angeles Judge Kevin Brazile dismissed Chavez’s case two years ago, saying that he had failed to show that an alternate gun design would have prevented the shooting. Brazile also said that a police department review of the handgun showed that the advantages outweighed the risk.

But earlier this week, the state appeals court ruled 3-0 that the suit could move forward,according to the San Francisco Chronicle. After reviewing evidence presented by Chavez’s lawyers, the court found that a grip safety “would minimize the risk of accidental discharge without undermining performance.”
In 2006, Chavez’s son accidentally shot him in the back after the off-duty officer forgot that he had left the loaded .45-caliber pistol under the front seat of this Ford Ranger. The child was not in a safety seat at the time.
