I am not there yet. I rather wait she files because

I hear if she does she has to pay legal fees. We don't have any kids and only own a home and have our own bank accounts. Is that right?.


This is a dumb case story by two unintelligent couple. Only valid point was made by the judge: The judge lambastes the parents for having “squandered” money that could have been benefitted their now eight-year-old daughter.

Who ever fies wins is a good rule to follow............they have time to work out the details they want.

No matter who files do not leave the house or the bedroom.
Abandonment and Alienation of Affections are the reasons for this.

If she files first just say no.

I am here in the US so I can not speak with certainty on Canadian Courts.

But I will say divorce is in general weight against the man.

Talk to a lawyer. One that is known for burying husbands in the divorce, before she does.
 
Don't file. Make up your own agreement. All the courts and lawyers will do is collect fees to split everything in half anyway.
i was lucky in one way, my wife volunteered to leave, which was good, but I was stuck with the carrying costs untill the house was sold, less than 3 months.
We met at a Tim Hortons and wrote up an agreement, downloaded free form. Separation agreement. The only thing we paid was $50 to get a notary public to sign it.
then we gave the agreement to the real estate lawyer who dispersed funds according to the agreement.

Im supposed to file and pay court costs for divorce papers, but in the agreement, she's already paid me half the costs.

i got the better end of dividing house contents, she didn't have room for king sized bed
and I got the full 7.2 surround entertainment system, and almost all the kitchen contents.
she got the lower end surround system and bedroom tv.

if you hire a lawyer, you are volunteering to pay and it is their business to make as much as they can from your misfortune
 
This sounds like a nightmare. I almost proposed to one woman back then but am so relieved I didn't.
 
"Fair" is a word used in court, but never applies to the male. Even if there's no kids.
 
Lawyers are worst that politicians and they get pay more to screw with you.
