tough titties, unless having sex in motel rooms was part of her job duties.

Was she on the clock?

If she was being paid at that time (to have sex), then yes she should be covered. If not, she should take legal action against the motel.

Why do they always use "emotionally traumatized" in all law suits. She was fucking it fell on her it hurt now collect some cash but I hate it when they use those words.

I hear you boing.....they want emotional trauma? Try losing a leg.....or get raped, that's emotional trauma......

I would say No to the claim. While there is some merit that the employer booked the hotel room and her staying there was part of her job requirements, having hard sex isn't part of the deal. Just like if she burned her lip while freebasing coke, rough sex shouldn't be covered. Another example would be if the hotel had a bungee jumping place on top (like vegas). If she got injured or "emotionally traumatized" that isn't or wasn't part of her job requirements either.....

I think "emotional trauma" gets thrown into a lot of lawsuits because it's a vague kind of thing that, if justified, can up a settlement amount/jury award significantly.

I agree she shouldn't win, because having sex is not necessary to job performance like sleeping would be. It does seem she might have a claim against the hotel, but she would have to be prepared to answer some really explicit questions...if I represented the hotel I would make her prove she didn't damage the light herself while she was "going hard".

I do not know? After all, if she did not get it hard, she might not have been in a good mood at work the next day!:he: I think the judge should have them film a re-enactment!
