If only this logic were ever to be legal there will be less violence.
A pair of Toronto police officers subjected a man in their custody to two five-minute beatings that resulted in him requiring plastic surgery to repair his fractured cheek, a packed courtroom heard Wednesday.
Keith Ryan testified he was handcuffed both times constables Manpreet Kharbar and Paul Ramos assaulted him in the early hours of April 24, 2011 while in their custody at the 14 Division police station.
Kharbar and Ramos had arrested the 35-year-old earlier that morning after allegedly assaulting a parking enforcement officer at Ossington Ave. and Queen St. W.
Ryan claimed the officers led him into a small dimly-lit storage room upon his arrival at the station, and beat him up for about five minutes.
A video shown in court shows Kharbar and Ramos leading Ryan into the booking room, where the duty sergeant admitted Ryan and then requested he be searched.
“I asked that the cameras be left on in the search room,” Ryan testified. “I was no longer sure what they were capable of, and I was scared.”
His request was denied and Ryan was led into the search room, where he claimed a second five-minute assault took place.
“You’re so pretty. I’m going to make you not so pretty,” Kharbar said, according to Ryan’s testimony.
The officers then rained down blows to his face and ribs before one of them struck him across the face with an extendable baton, Ryan told the court.
He said Kharbar and Ramos then had him fully strip down — which the booking sergeant testified the day before wasn’t standard procedure — to conduct their search.
A second video played in court showed Ryan being escorted out of the search area 10 minutes later with a cut and some swelling around one of his eyes.
“I was in complete shock,” said Ryan. “I decided to just keep my mouth shut as I didn’t know what else would happen to me.”
But Peter Brauti, Ramos’ defence lawyer, said Ryan’s claims weren’t backed up by the videos and photographic evidence.
Brauti called Justice Robert Kelly’s attention to a series of photographs that were taken by a staff officer following the first alleged assault.
The lawyer pointed out that there seemed to be no physical traces of Ryan being repeatedly punched in the face.
Brauti added that the video shown in court shows Ryan walking normally into the booking room, and again with no discernible markings on his face.
“It’s in your interest to lie about the abuse that took place, isn’t it?” he asked Ryan.
The trial continues.
