I think the student was at wrong. He was carrying a gun so doesn't that makes him suspicious?.

Each State has it's own laws. Apperently he is entitled to carry his gun. A well spoken young man and kudos to him for talking to the cop with respect and authority.

Passive aggressive behaviour on the young man's part. He is polite, both remained civil, but the young man was certainly attempting to pull a power play. Ok, so the young man is free to go with his firearm and is jumped later and his weapon is used to kill him.

Eitherway= DUMBASS.

I don't think that I'd be trying that any time soon. One would think that with an open carry you would at least have to prove that you have a permit for that.

I'm curious. Why is it inappropriate to exert authority with a peace officer? Do peace officers hold absolute authority over the citizens they serve?

Moreover, why do you assume that the young man does not know how to use his firearm or defend himself?

He could've been more humble. He spoke with too much arrogance.

Just my 2 cents.

You know what they say about a little bit of knowledge...in a law student, no less.

He knew his rights and the Officer couldn't do a thing based on their laws. The Officer tried and tried to fish information out of him but the young lad was having none of it. Shrewd future lawyer for sure.

He had every right to ask the questions he did, and allow the laws of the state to protect him in the manner they were designed to. At no time was he rude, or impolite.

Kudos to him.

and I KNOW someone will jump in regarding the black man in the BMW... :NoNoNo:

There is a way of expressing yourself, I just think if
he had gotten the wrong cop he would have had
issues......

The video camera and a smart ass quoting of jurisprudence makes it pretty obvious that he was baiting the cops and hoping to become a FoxNews lead story.....

The kid is a dick plain and simple.

You know damn well why the cop stopped you. You are not doing anything wrong then don't be a dick about it and just show that you are not doing anything wrong. Cop was just doing his job.
our
All the quoting and video tapping and arrogant overly polite convo was bullshit.

Like I want my cops having to waste their time with bullshit calls like this. Just prove your shit and move on.

Looks like somebody was intentionally trying to get stopped so he could prove a point.

As FF said this is just a waste of the police officers time and I'm not sure what message it shows to the real thugs out there.

So the kid was a smart ass. I don't think he was overly polite. He was cocky.

But there is a valid point. Cops are not the ultimate authorities and they don't get to play god. Walking down the street with an open carry IS asking for it. But what if it's a lawful young black man driving his new mercedes who gets stopped?

The lesson is that every citizen has the right to demand an explanation as to why he/she has been stopped. If one cannot be given, then get on with it.

I respect cops. I admire their job. I work with cops on a regular basis. But anyone who has a problem challenging cops with legitimate concerns probably hasn't been on the wrong side of racial profiling or cops getting a bit carried away with their perceived authority.....

I get all that. I really do, but this kid didn't help in changing any of that.

There is also a difference between standing up for your rights - which I fully support - and being a dick about it. The kid was being a dick about it.

"uh uh, according to section 15, subsection 19 - I do not have to give my name so you can put it in your database"

Just say " Sorry sir, I have the right to refuse giving information especially since I have not done anything unlawful. I am evoking that right. Thanks."

See the difference. He was being a smart ass because he wanted to show the cop who was boss. I hate when punk ass cops do it, I hate when punk ass civies do it. There is no need for it.

The cop had a valid reason to stop the kid and at least ask him some question to ensure that he was not some nut carried a weapon. Don't be a dick about it. He is doing his job. Let him do it.

Fair enough.

As an aside, I just got a 32Gb memory card so I can record more encounters on my phone

I have to agree, this was a setup plain and simple.

I realize that we can't allow the police to be judge and jury and rely on them to act accordingly...but, sorry, if someone is walking down the street with a gun in his hands, the police SHOULD have the power to stop them and make inquiries.....

IMO, this is a prime example of what is wrong with america today. If a judge anywhere at anytime passed a law or made a ruling that prohibited the police from using the excuse "he was carrying a gun in plain sight" to stop and make inquiries how the hell are they supposed to stop crime?

For example: since this video was produced to show what is legal and illegal in that city, what's to stop 4 gangbangers from walking up to the kid making the video and shooting him in the head for his ipod? The cops now can't stop them as the kid proved.....

And another thing: i'm getting sick and tired of people using this example of how the police stop all black people who drive fancy cars.....the example in the news wasn't so...bigoted...the guy in the bmw in his driveway matched the description of a wanted suspect......in the area the suspect was last reported in...he wasn't just some random guy driving down a random area.......if this was happening as much as people purport, the news would be full of these cases.....

just one more thing:

this is another prime example of my proverb: just because something is legal, doesn't make it right and just because something is illegal, doesn't make it wrong....
