IMO, this is a prime example of what is wrong with america today. If a judge anywhere at anytime passed a law or made a ruling that prohibited the police from using the excuse "he was carrying a gun in plain sight" to stop and make inquiries how the hell are they supposed to stop crime?

And another thing: i'm getting sick and tired of people using this example of how the police stop all black people who drive fancy cars.....the example in the news wasn't so...bigoted...the guy in the bmw in his driveway matched the description of a wanted suspect......in the area the suspect was last reported in...he wasn't just some random guy driving down a random area.......if this was happening as much as people purport, the news would be full of these cases.....

That's your opinion and you're entitled to it, but then your beef is not with the case law on inquiring and detaining lawful citizens. What you need to challenge is the Second Amendment and open/concealed carry laws. You can't very well allow citizens to smoke cigarettes yet be able to stop and question them arbitrarily on the street if they happen to be puffing away....

not sure what the second ammendment is but comparing someone carrying a loaded handgun to someone smoking cigarettes is ludicrous......in case you forgot, the only reason people smoke only outside is because laws were passed forcing them to....no one forced this young man to carry a handgun......

Now if you want to compare someone carrying a gun to someone driving erratically, then that's a fair comparison...no one can immediately kill someone else with a lit cigarette but someone certainly can kill someone else with a loaded handgun or motor vehicle.......
 
oh, and further to this "legal to carry a loaded handgun in public" issue, we have restricted weopans up here and I work with someone who has handguns (legally). He says sure, it's a bit of a pain having to carry them in a special case locked in a trunk, but hey, that's what you gotta do....unlike the US where people would freak the hell out if anyone dared to even suggest such a thing....

Yeah, we all have a right to bear arms, but do we really have to? nope.....
