Read the details, particularly the part by the dessenting judge. She consented before and after and consented to the dangerous sex play that caused her to lose consciousness.

While it is difficult to disagree with the statement and ruling that you need to be conscious to consent there remains considerable doubt as to whether this woman did consent before which was why the original conviction was overturned.

I see what you're saying, because of the emphasis on continued consent in the ruling. But I would think you could argue that "unconscious" and "asleep" are two very different things.

Man or woman.....there are people out there that are very vindicative or insecure....watch out for them.

I think that is something that is missing in today's society: the fact that so many still believe that women have it, men want it. EOS. That anytime before, during or months afterwards, if a woman decides that she might NOT have wanted it, the guy raped or assaulted her.

For the record: when you're asleep, you're considered in a state of unconsciousness (by the medical profession so the law stands).

This is a BULLSHIT ruling mainly because it was brought about only because society gave the woman the ammunition she required to use against her ex in a custody battle. What's next? Throwing a guy in jail for THINKING about having sex with a woman? Jesus...what's the world coming to.....

Just remember guys: now, anytime you have sex with a woman, up to 7 yrs later you can be arrested and found guilty of sexual assault. Doesn't matter if she said yes, doesn't matter if she's your wife, doesn't matter if you paid for it.

As for that story about the guy who had the drunk chick come into his room? What are we supposed to do, carry around breathalizers now???

CG: not that you may ever encounter this (I hope you don't) but you better keep a release form next to your bed listing all the sexual activities you might partake in at any given moment. ie: toy in vagina, toy in bum, penis in vagina, penis in bum, daty, digits, etc. and have your wife sign them BEFORE you begin. Hell, you could be the next story we read about.......

But even if you DO get a woman to sign a consent form, I bet some do gooder judge will say "she was under duress when she signed so it doesn't matter" hell, they throw out prenuptuals now.....

Yes but how does one know if she's intoxicated? Does Mr Peace carry around a breathlizer? Some women get loopy on 2 glasses of wine and some can drink a whole bottle. Some can drink 4 or 5 shots and still be relatively normal, yet be over the limit to drive.

Know what this thread tells me? Don't ever have sex with a woman ever again......if you do, you run the risk of jail time.

I'd mark these dates down on a calendar just in case you ever get into a custody battle.......

Which gives me a thought: how sexist was that ruling? at NO time did the judge say "people", it only focused on women. So I guess in her mind she feels that it is ok for women to assault men?

lol tboy...I just know. i have seen some of the women who made advances toward me were drinking all night. However, you are right if I was meeting a female stranger...how would I know but then again, I rarely meet strangers. so...

One of them showed up at my work yelling at me in front of my colleagues. Anyone with similar experience?

She wasn't my "type" to begin with, but we were friendly and she didn't wanna go to some wedding by herself, so I agreed to go with her as her date. As luck would have it, she wanted more out of the date than I did, and she totally put herself out there for me, but I just wasn't feeling it AND she was drunk, (we both were) and that's a line I will not cross...
