TORONTO - If drug dealers actually have a video showing Rob Ford smoking crack, there’s no legal way for Gawker’s “Crackstarter” initiative to make the transaction, a former Toronto Police officer suggests.
Completing the deal would likely run afoul of proceeds of crime and money laundering laws, said Ross McLean, who also worked in criminal financial investigations in the private sector.
“There are lots of ways you can get the money over to them, but it could be illegal,” said McLean.
Gawker, an American gossip site, offered to “crowdfund $200,000 to purchase and publish a video of Toronto Mayor Rob Ford smoking crack cocaine” and raised $201,254 from 8,388 people.
However, they “lost contact with the people who have custody of the video” and Gawker editor John Cook appears to be mum on how — or if — the money will be transferred to the video owners.
McLean said it will be easier said than done.
“If the criminals who are selling (the video) receive any money directly to the commission of an indictable offence, (it then) makes it into proceeds of crime,” McLean explained. “Then you get into questions of money laundering where converting that memorabilia — that video — into money could be defined as laundering.”
If Cook came to Toronto to make the deal, he’d have to explain the situation to border guards, who could turn him away for coming in the country to commit a crime, McLean said. If the alleged drug dealers get across the border to pick up the cash, the “proceeds of crime” section of the Canadian Criminal Code still applies outside of Canada.
“It’s up to the police and the Crown if they decide they want to lay a charge,” he said. “This is the unknown factor.”
As for wiring money to a Cayman Islands account? Think again.
“When you wire money anywhere, the bank has to fill out a form and the government gets notified you sent money overseas for every transaction,” McLean said.
As of May 27, Cook said he has had no further contact with the purported video owners.
The Gawker editor could not be reached Friday.
It’s been reported the video owners shopped the footage to several media outlets.
But McLean warns newspaper chains and other media companies could also face the “proceeds of crime” charge by purchasing the video. In addition to that, they run the risk of being fined up to $50,000 by the attorney general under the Ontario Prohibiting Profiting from Recounting Crimes Act.
“In Ontario, if a person decides to retell their crime — this video may likely qualify — they cannot collect a profit from doing this,” he said. “If a profit is made from the recounting of a crime, this money must be paid to and received by the attorney general, and not the offender. The minister will then distribute the money to the provincial victims’ fund.”
This law also applies to any memorabilia from the crime, such as Gawker’s offer to give the iPhone, which was used to shoot the alleged footage, to the person who donated $10,000, McLean said.
