New York (CNN) -- A cashier at a New York fast food restaurant has been charged with felony assault for beating two unruly customers with a metal object during an argument, after cell phone video captured a scene in which one customer climbs across the counter in an apparent attempt to reach the store employee.

The women remain hospitalized in serious condition, police said.

The incident occurred at a McDonald's on West 3rd Street about 12:30 a.m. Wednesday.

The two 24-year-old women entered the store, placed their order and then began arguing with the cashier, 31-year-old Rayon McIntosh, police said.

CNN affiliate WCBS said the altercation began when the cashier questioned a $50 bill the women gave him. They responded by hurling obscenities at him.

A cell phone video shows how the situation quickly escalated.

One of the women curses at the cashier, then reaches over and slaps his face.

The woman then climbs over the counter, sending the cashier running toward the kitchen area. The other woman walks around to join her friend.

The cashier then suddenly reappears with what police described as a metal object and repeatedly hits the women.

Restaurant patrons scream for him to stop, while other employees try to intervene.

The video, one minute and 10 seconds long, shows the cashier hitting the women 10 times as they lay on the floor.

"Stop! Stop!" one woman screams. "Stop it! Call the cops!"

The cashier would pause and begin again every time the women tried to get up.

The two women suffered lacerations to their head and face and were taken to a hospital, police said. One of the women suffered a fractured skull and a broken arm, according to a complaint filed by the Manhattan District Attorney's Office.

Authorities identified them as Denise Darbeau and Rachael Edwards, and charged them with menacing, criminal trespass and disorderly conduct.

McIntosh is currently being held at the Manhattan Detention Complex on $40,000 bail. His next court date is set for October 18.

The franchise owner Carmen Paulino told CNN affiliate WABC that McIntosh no longer works at the restaurant.

"I am extremely disturbed by the events captured on tape and am concerned for those injured," Paulino said. "The actions of this individual are unacceptable and not characteristic of my employees."

McDonald's also released a statement, saying the franchisee is cooperating with the investigation.

"The violence in this video is alarming and reprehensible," it said.

I agree. They both had no business jumping over the counter. They only have themselves to blame for escalating the situation.

 
The cashier blew a gasket but I can't say I blame him. The slap in the face was the trigger and they got what they deserved.

This one is up for the judge....yes they "started" it by screaming obscenitites at him, then escalated it by physically assaulting him, and then chasing him? FUUUCK if he had hit them a couple of times to put them on the ground and keep them there, he'd probably be hailed a hero.....

As with many situations, he went just a little too far.......

But I tell you, one day people will realize they can't just walk around doing what they want (the women) to whomever they want. You never know just who you are fucking with. This time they fucked with the wrong guy.....hopefully they learned something but probably not.

You have to remember: they aren't the victims here.
 
What did she think she was going to do jumping over the counter?? I'm sorry but she got what she deserved, I'm not sure if her friend did, maybe she was going in to try and stop her friend, i dunno. People are losing their minds, they really are.

There are certain people who take EVERYTHING as a personal insult and I would say that's what happened here. The cashier was just doing his job, protecting his employer from possible counterfeit bills yet these two women went on the offensive feigning an insult. Most would just think: OMG is that fake? FUUUCK me I just lost 50 bucks, these two? ahem........how DARE that cashier even THINK about not accepting that bill.

The more I think about this the more I think the employee has grounds for an illegal dismissal suit. Should he have been fired for protecting his employer? I seriously think not.

Once again, he probably went slightly over the line but he sure as heck didn't start this......but he sure as hell finished it. I'd really like to know on what grounds did the cop(s) charged him? I mean hell, it was obviously self-defence......I guess it is legal to shoot someone on your private property but if you're out in public you're not allowed to defend yourself.......
 
First this women (thug in my view) think because shes pissed of at what ever, she can attack him.

Then she gets all brave because she thinks the dude is running away because hes scared. Wrong.

So now she is going to really be a bad ass as she thinks she can now do what ever she wants as nobody is going to stop her because they are afraid of her, wrong.

I'm going to go behind the counter and attack this guy some more, wrong..

Not so long ago if a person did something like this, everybody in the store would have jumped on her and there would not be much left for the cops to take away. Right.

People are learning. You see people in airliners jumping on some nut if they are acting badly. Right.

You have the right to DEFEND yourself from ANY threat that puts you in fear of death or injury. Right

And to keep " DEFENDING " yourself until YOU are SURE that the threat has been REMOVED.Right

Keep swinging dude, shes still trying to attack you. Right.

Mickie D's should give this guy a award for "saving the customers" from this nut. Well done young man, but next time put your body weight in to it and your arm strenth together. Right.
 
All you guys are fucked up. The cashier has a right to use proportionate reasonable force to defend himself. For example, he could have slapped or perhaps even punched back.

Instead, he beat the women to the ground with an iron bar and kept smashing at their skulls until he fractured 1 victim's skull.

He will do a couple of years' jail time for an "unreasonable force" assault and probably get sued for many million $ and spend the rest of his life paying off the judgment.

You guys' have NO IDEA what the law says about this type of case.

Have too agree with your post. Will add though that if I was on the jury I would not convict him.

Bottom line is that these two wanted to provoke an altercation and they sure in hell found one didn't they?

I do know about the law. Yes he is in real trouble but a good lawyer will show the video of the woman slapping and insulting him first. Self defense would be my take. Now on the other hand the man is a fucked up dude for striking them so severely. Laws are not the same in Canada as they are in the USA.

I remember half a year ago there was a McD footage of two girls beating up a transsexual girl which was A MILLION TIMES MORE DISTURBING because they beat her for the SOLE reason that "she" was transexual.

This? At least there was a motive. Do I condone the behaviour? No. Is it understandable? Yes. I don't know about the taller girl, but it was the shorter girl who was the one who climbed over the fence and felt like she was all big and bad and shit. Well guess what? Now you learned that climbing over the counter to slap a customer is NOT the right way to do things.

What the guy did wasn't right either. Uh-uh. Part of the job is to be able to tolerate shit like this. There's always going to be aggressive, idiotic people around and fighting back isn't the right way to do things.

Dude, it wasn't an iron bar, it was classified as a metal object......don't read into fact things that are not fact......

They pursued him. From what I could see both "ladies" were larger than him. To keep hitting them until they couldn't get up anymore (to pursue him some more) is prudent.

I just noticed upon re-reading that they actually were charged. But not with assault....wtf? They struck him and chased him to do MORE damage....that's fucked up. I guess buddy should have let them beat him senseless THEN defended himself....

Shelley Lynn claims her ex-husband, Keith Handley, hired her to work the counter at the Mickey D's franchise he owned in 1982, started dating her, and then pushed her into prostitution so she could earn more than her burger-slinging minimum wage. So what's her beef with McDonald's? She claims the chain doesn't "ensure employee policies are in place to protect against unscrupulous and criminal individuals like Handley." Lynn is suing for lost wages, punitive damages for sex trafficking and racketeering, among others. Hold the special sauce jokes, please.
