Big sigh! Yes and thus my comment regarding accounts of differing outcomes.
Actually there seem to be different accounts as to the outcome of this story but I choose to like this one best.

I know yorkies can be noisy little fuckers, a friend had one on his boat and it barked 24/7.......
I'm not saying it deserves/d to be shot, but there have been times when I lived in the city if I had had a gun, I would have been severely tempted to use it. Owners just don't realize how utterly annoying a barking dog can be to their neighbours. In fact, there is a section specifically detailing this in the by-laws. I was off sick with the flu one day and backed onto an alley between two buildings. Every little sound would echo up and down the alley. Well at 10 am this dog on the first floor started barking. It carried on non-stop for 2 hrs until I finally dragged myself out of bed and took the elevator to the first floor. I knocked on the door for a good 5 minutes until finally the owner answered. I said "do you realize your dog has been barking for 2 hrs"?/ "oh yeah, I know..." so I said "shut it the fuck up"!!!
I'm not saying this IS what happened here, but I have a hard time believing that someone would just think "hey, I'm want to shoot a dog" and just go out and find any dog and shoot it....1) how'd the shooter get into the backyard? 2) Do they back onto an empty field? 3) did the shooter access their backyard via a neighbour's backyard? 4) Was it a neighbour?
There's a couple of indicators here: 9 pm and running around energetically. I know yorkies and if it was running around energetically it was barking. Could have been chasing squirrels, could have been chasing birds, I have a friend who has a scotty dog and she showed me how "funny" he was when there were birds or squirrels in the back yard. She would let him out and he'd go nuts barking and running around after them like a mad man. She thought it was so cute. Until I said to her: you're probably driving your neighbours nuts with all the racket. She said "so"??? A prime indicator to me that she is an inconsiderate dog owner.....
This could be totally random and totally unprovoked, but I suspect it isn't.....
I agree with your analysis but shooting a dog for barking still makes the shooter a person with no intelligence. I myself have had my share of noisy barking dogs. No never been tempted to shoot the dog if I had a gun.
My thoughts were of doing the neighbor's wife as revenge. :tongue:
Imagine if the little girl was playing with the dog and she took the shot :shock:.
yeah that would be horrible, but the whoever did it must have been a good shot, he hit a small yorkie running around energetically......at dusk no less.....
